Welcome to Hi Remi, a SaaS solution owned and operated by Mountain View Consulting FZCO, License Number: 46358, registered under the International Free Zone Authority (IFZA), Dubai, UAE (referred to as "Hi Remi," "we," or "us"). These Terms and Conditions govern your access and use of our services. By using Hi Remi, you agree to these Terms and Conditions.

1. User Access and License

Hi Remi offers both a free version with limited functionality and subscription-based access to our AI-powered candidate search platform. By signing up, you agree to the following usage limitations:

• Freemium Plan: Users have unlimited searches but can access only up to 10 candidates per search.
• Standard Subscription: Users have unlimited searches but must adhere to fair usage policies:
  
  • Up to 80 searches per month.
  • Maximum of 2000 candidate exports per month.
  • Designed for individual recruiters, not agencies.
• Expert Package (for Firms Specializing in Candidate Collection): This includes headhunting firms, staffing agencies, sourcing-as-a-service providers, and any business whose primary function is sourcing candidates for customers. Custom pricing and usage limits apply based on contractual agreements.

User accounts are non-transferable for Freemium and Standard Subscription users. Expert Package users may transfer accounts based on individual agreements.

2. Data Collection and Privacy

Hi Remi collects personal data such as email, first name, last name, role, and company details, as well as behavioral data to improve user experience. We may also collect business-related information, such as hiring plans, revenue, and headcount forecasts, to enhance candidate shortlisting.

We comply with UAE Federal Decree-Law No. 45 of 2021 (UAE Data Protection Law) and GDPR where applicable. You can review our privacy policy:

3. Third-Party Services and Data Accuracy

Hi Remi uses a third-party provider to access publicly available profiles. The third-party provider is solely responsible for ensuring compliance with GDPR and UAE data laws, maintaining data accuracy, and handling updates and deletions.

Disclaimer: Hi Remi does not guarantee the accuracy or completeness of third-party data. Users are responsible for verifying candidate information before hiring.

4. Payment and Subscription Terms

• Freemium Plan: Free with limited functionality.
• Standard Subscription: Payment is required upfront, either monthly or annually.
• Expert Package: Custom pricing based on a contract.

Automatic Renewal:

• Subscriptions renew automatically unless canceled at least 3 days before the renewal date.
• No refunds are provided once a payment is made.

Non-Payment:

• Failure to pay results in immediate suspension of access.
• No data or service access will be available until payment is made.

5. Pricing Changes and Renewals

• Prices may change, and we will provide a 30-day notice before any adjustments.
• Users on monthly plans will receive notice 30 days before pricing changes.
• Users on annual plans will receive notice 30 days before their renewal date.

6. Intellectual Property

The software, data, and brand are owned by Mountain View Consulting FZCO, UAE. Users do not own any rights to the software or data provided by Hi Remi.

Users may only access publicly available data through our platform, but all underlying technology, algorithms, and intellectual property remain the exclusive property of Hi Remi.

7. Termination and Cancellation

• Monthly Subscriptions: Users can cancel anytime before the renewal date.
• Annual Subscriptions: Users must cancel before the renewal date to avoid auto-renewal. Upon cancellation, they will retain access to the Freemium version but lose access to previous searches and data.

8. User Responsibilities & Restrictions

Users must not:

• Resell, share, or distribute data obtained via Hi Remi.
• Engage in illegal activities using the platform.
• Store candidate personal data without ensuring compliance with their region’s data protection laws.

Hi Remi reserves the right to terminate accounts that violate these terms.

9. Limitations of Liability

• No Refund Policy: Once a payment is made, no refunds will be issued.
• No Hiring Guarantees: Hi Remi is an AI-driven sourcing tool. We do not guarantee successful hires or candidate accuracy.
• User Responsibility: Users are responsible for verifying candidate credentials and ensuring compliance with applicable laws.
• Indemnification: Users agree to indemnify Hi Remi from any claims, damages, or liabilities arising from their use of the service.

10. Dispute Resolution

All disputes shall be governed by UAE law, specifically under the jurisdiction of Dubai Courts. Users agree to first attempt an internal resolution process with Hi Remi before escalating legal action.

11. Service Availability and Support

Hi Remi aims to provide uninterrupted access to its services but does not guarantee 100% uptime.

• Standard Support: Available during business days with a response time of 1-5 business days.
• Urgent Support: Available during business hours (10 AM – 6 PM UAE Time).

12. Changes to Terms and Conditions

Hi Remi reserves the right to update or modify these Terms and Conditions at any time. Changes will be notified in-app or via email. Users who continue using the service after updates are deemed to have accepted the new terms.

13. Miscellaneous Provisions

• Force Majeure: Hi Remi is not liable for service disruptions caused by unforeseen events (e.g., natural disasters, technical failures).
• Severability: If any provision of these Terms is found unenforceable, the remaining sections remain in full effect.
